Litigating Equipment Lease Contracts is a complicated and usually one sided business...after all, the Leasing Company wrote the contract, imposed the terms and enforces its contracts on a daily basis...BUT...there are avenues to level the playing field and create defenses to what can be seen as extortionate claims..a free 60 minute consultation can clarify the strengths of claims and defenses...I joined the Equipment Leasing and Finance business over 40 years ago following successful sales careers at ICL, Xerox and NEC Corporation in the UK and Europe...followed by 10 years in in sales and sales management of equipment lease origination teams and 30 years in Portfolio Management in the USA, managing equipment portfolios in totaling excess of $4.5 Billion equipment cost, negotiating and managing early and End of Term Purchase, Renewal and Return Options for leased equipment including plant and machinery, oil & gas equipment, yellow iron, mining and manufacturing equipment plus all forms of transportation assets among others. I am highly experienced in lease contract negotiations for conflict resolution, litigation and arbitration having routinely been depositioned and appeared as principal witness as needed as corporative representative for California First Leasing Corp (Calfirst Leasing), CG Commercial Finance and First National Capital Corporation, all based in Southern California but doing business nationally in all 50 states. I am well versed and skilled in equipment disposition during and at the expiration of the Lease Term either for voluntary return or involuntary recovery of assets and their resale. Equipment Lease Contracts can be confusing if not well understood and assumed benefits of the Lease can be lost if not well negotiated.. things to consider in any litigation: Negotiating with a Leasing company Leasing Terms and their real definitions The Importance of Dates and tracking them Legal Venues and their implications Definitions of Fair Market Value versus Orderly Liquidation Values The relevance of Equipment Appraisals Unforeseen Renewal Terms Return Provisions and how costs can escalate A Lease is not a Loan..no amortization Unforeseen Lease Obligations Pre-Commencement Rent and its application Progress Payments prior to commencement of the lease term What is Interim Rent? The Lease Approval process from Letter of Intent through final documentation What is an Assignment? When to litigate and when to settle..
